By accessing or using BookMate's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including healthcare professionals, clinics, and their staff.

2. Description of Service

BookMate provides an AI-powered appointment management platform designed for healthcare professionals. Our services include WhatsApp-based appointment booking, automated reminders, and related practice management tools. We continuously improve and may modify features without prior notice.

3. Account Registration

To use BookMate, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorised use.

4. Healthcare Professional Responsibilities

You are solely responsible for ensuring that your use of BookMate complies with all applicable healthcare regulations and professional standards in your jurisdiction. BookMate is a practice management tool and does not provide medical advice. All clinical decisions remain your responsibility.

5. Patient Consent

You are responsible for obtaining appropriate consent from your patients before using BookMate to manage their appointments and send them communications. You must inform patients about how their data will be used and stored.

6. Acceptable Use

You agree not to: use the service for any unlawful purpose; transmit any harmful, threatening, or offensive content; attempt to gain unauthorised access to our systems; interfere with or disrupt the service; use the service to send unsolicited communications to patients.

7. Intellectual Property

BookMate and its original content, features, and functionality are owned by BookMate and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without written permission.

8. Payment Terms

Certain features of BookMate may require payment. Pricing and payment terms will be clearly communicated before you incur any charges. Fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with reasonable notice.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may suspend or terminate access for maintenance, security, or other reasons. We will endeavour to provide advance notice when possible.

10. Limitation of Liability

To the maximum extent permitted by law, BookMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BookMate and its affiliates from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another party.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the service will immediately cease. We will provide you with a reasonable period to export your data before deletion.

13. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Lisbon, Portugal.
